Councillor Des Guckian outlined his dissatisfaction with zoom meetings and outlined his view that they are not as effective as having Main Council meetings and Municipal District meetings face to face.

 

Cathaoirleach, Councillor Mary Bohan acknowledged this but outlined the need for Leitrim County Council to adhere to national public health advice and guidance.

It was AGREED that Leitrim County Council proceed with the works in accordance with the approved plans.

 

Councillor Des Guckian sought clarification as to what is the justification for such an extension when Leitrim County Council financial resources will be seriously threatened and there will be some cut backs in services in this county and he asked that it be left one side.

Mr Lar Power, Chief Executive said that The Hive had been at full capacity before the COVID pandemic and an application had been made for funding and this funding has been secured through Enterprise Ireland and the National Town and Village Scheme.

Councillor Enda McGloin said the proposed extension to The Hive will ensure the building is well resourced and will create further employment in the area.  Councillor Justin Warnock and Councillor Padraig Fallon welcomed the proposed works taking place.

Consider agreement with Roscommon County Council concerning the design, construct and completion of the Hartley Bridge Project

It was AGREED that Leitrim County Council being the administering authority agrees to the making of agreement concerning the design, construction and completion of the Hartley Bridge Project under Section 85 of the Local Government Act 2001 with Roscommon County Council.

Consider the Annual Financial Statement for the year ended 31st December 2019

Minutes:

The Annual Financial Statement for Leitrim County Council for the year ended 31st December, 2019 was circulated to the Members.

 

Mr. Vincent Dwyer, Head of Finance, Water, Environment, Climate Action and Emergency Services advised Members that Leitrim County Council has continued to implement a programme of monitoring and reviewing expenditure to ensure that budgetary limits are not exceeded.  The effect of such tight budgetary management and control has resulted in a surplus of €1,524 in 2019 thereby reducing cumulative revenue deficit of €259,116. Total revenue expenditure by Leitrim County Council in 2019 was €42,865,032.  The total capital expenditure by Leitrim County Council in 2019 was €22,493,962.  Income received from NPPR in 2019 was €433,887.

 

In 2019, Leitrim County Council continued to pursue the collection of outstanding revenue through a combination of engagement and enforcement.  In this regard, Commercial Rates Collection was sustained at 83%.

 

Councillor Des Guckian queried the following: -

 

·         Figure of €1,031,970 accumulated costs at 1/1/2019 relating to Computers, Furniture and Equipment

·         Why there was a reference in the notes to COVID-19 when it had not happened in Ireland in 2019

·         Leitrim County Council should make an investment in rural communities and have it on par with urban settings. Cllr Guckian referred to a figure of almost €400,000 for Town and Villages Renewal schemes. Cllr Guckian said he did not begrudge urban settings but would like to see money spent on rural communities.

 

Mr Vincent Dwyer, Head of Finance, Water, Environment, Climate Action and Emergency Services responded as follows: -

 

·         Advised a breakdown of the accumulated costs at 1/1/2019 relating to Computers, Furniture and Equipment will be forwarded to Cllr Des Guckian

·         Advised by the Department of Planning, Heritage and Local Government to put a note in Accounts at this time as initial reports were emerging from China about COVID 19 and it is prudent to flag at this stage in the accounts, as it may have an effect on the following year

·         Towns and Villages is a broad heading in the Revenue Account which includes an allocation of staff salaries across various sections of the organisation.  He acknowledge that the income from grants and subsides for Urban and Village Renewal Schemes is not clearly shown, but that  the associated Income is included in the Miscellaneous Income total

Consider the Draft Annual Report 2019.

It was AGREED to adopt Leitrim County Council’s Draft Annual Report, 2019.

 

Cathaoirleach, Cllr Mary Bohan paid tribute to the staff that had complied the report.

 

Councillor Des Guckian referred to the Draft Annual Report as being very sketchy and said it deserves further discussion.  Cllr Des Guckian queried a major emergency exercise that took place, recruitment of staff, and sought clarification on the Carrick-on-Shannon By pass/Ring Road and the Dromod/Rooskey By pass.

 

Councillor Padraig Fallon welcomed the recruitment of staff.

 

Ms Mary Quinn advised that the Annual Report is for 2019 and it records any activity that may have taken place in any year and it does not have to be excessively detailed.  The major emergency exercise that took place on the N4 took place in a previous year. The Major Emergency Plan is a separate detailed document that plans and prepares for dealing with major emergencies.

Report from Corporate Policy Group

Minutes:

Ms Mary Quinn, Director of Services, Housing, Corporate Services, Community and Cultural Services outlined that the Corporate Policy Group considered the following: -

 

·         Schedule of meetings 2020/2021

·         Update on Financial Management

·         Review of items listed on the agenda for the Council meeting.

·         Attendance of Members at forthcoming Conferences/Seminars was agreed by the Corporate Policy Group.

·         Further Council meetings will be held in the Bush Hotel, Carrick on Shannon,

Visitors Centre, Drumshanbo or other such suitable venue where social distancing can be adhered to while COVID restrictions remain in place.

Management Reports - February, March, April & May 2020

Minutes:

The Management Reports for February, March, April, and May 2020 was circulated to Members in accordance with Section 136 (2) of the Local Government Act, 2001 as inserted by Section 51 of the Local Government Reform Act, 2014.

 

 

Councillor Brendan Barry welcomed the works on the bridge in Ballinaglera as part of the Leitrim Way.  Cllr Barry referred to Farmers in Leitrim who could lose out on thousands of euros from payments under the walks scheme this year.  120 places in the county were approved last December and 42 farmers are eligible to get payments from Battlebridge to Dowra.  There is an issue whereby the appointment of Rural Recreational Officer who would deal with paperwork and submitting applications for farmers has not just been appointed due to the COVID 19 lockdown.  The average payment for farmers to work on maintaining the walks is just over €1,000 per year.  Councillor Brendan Barry called Leitrim County Council to call on the Leitrim Development Company to get an extension on the process so that a Rural Recreational Officer can be recruited, and farmers can get their payments.

 

Members supported the proposal.

Councillor Padraig Fallon noted the correspondence received in this regard does not deal with the income threshold and he said he has made contact with the Department on several occasions and he requested that further communication issue to the Department in relation to this issue.

 

·        Resolution from Cork County Council dated 28th February 2020 writing to Department of Health, Department of Justice and Equality and the Department of Children & Youth Affairs requesting recognition is given to Parental Alienation as a child welfare issue and to call on the Government to implement the recommendation of the Report on Reform of the Family Law System October 2019.

 

·        Letter dated 2nd April 2020 from the Office of Minister of State with Special responsibility for Financial Services and Insurance acknowledging Resolution passed by Leitrim County Council in relation to the cost of Insurance.

Councillor Des Guckian sought an update in relation to this issue.

The Department are drafting policy documents now and we are waiting on a response in relation the submissions.

That we call upon all political parties and Independents in this state to immediately begin work on drafting a new National Plan that will take into account the real and new national Planning needs of Ireland in the post-COVID situation. Councillor Des Guckain gave the background to his motion and called on all political parties and independents to begin working on the New National Plan blueprint as the old one is obsolete and COVID has altered Ireland and it is important to revitalise rural Ireland and the West.  Councillor Des Guckian proposed that all parties be notified of this.

Provide an Ophthalmic Service in new Medical Centre, Carrick-on-Shannon - Councillor Sean McGowan

I seek the support of members in calling on the HSE to provide an Ophthalmic service in the new Medical Centre currently under construction in Carrick on Shannon. This service was previously in Carrick and it was moved to Sligo University Hospital. We will have a state of art facility when the new centre opens and now is the time to make provision for this much needed service.

Rebuilding Ireland Home Loan Applications - Councillor Padraig Fallon:


I ask Leitrim County Council what element or percentage of commission earned is taken into account when assessing income thresholds for Rebuilding Ireland Home Loan applications, if it is a Department guideline, if such a guidelines can be issued in reply and how this compares with percentages used by banks.

Report by Head of Finance, Water, Environment, Climate Action and Emergency Services

"All applications for loans under the Rebuilding Ireland Home Loan Scheme are assessed in accordance with the eligibility criteria for the scheme.  The maximum income threshold for a single applicant under the Rebuilding Ireland Home Loan Scheme is €50,000 and in the case of a joint application the upper income threshold is €75,000.  In assessing commission-based earnings, a maximum of 30% of the commission based earnings are assessed in the calculation of assessable income as provided for in the Credit Policy. In this regard, the Housing Agency complete the assessment and make a recommendation in line with the above criteria. Details in relation to the criteria/guidance on the lending criteria for the individual banks would have to be sought separately from the institutions."

 

Councillor Padraig Fallon acknowledged the response and said he was not satisfied with the response received.  Councillor Fallon said that a PQ had been put forward by Deputy Martin Kenny in the Dáil as requested by the applicants in this case.  Cllr Fallon said that in assessing commission-based earnings, a maximum of 30% of the commission-based earnings are assessed in the calculation of assessable income.  In this case, the applicants were €804 over the threshold.  Cllr Fallon said these applicants are both hardworking, have young children, one of the applicants is a frontline worker and he proposed that the Department must review the income thresholds for Rebuilding Ireland Home Loan Applications. Cllr Fallon noted different banks use different percentage rates for lending.

 

Mr Vincent Dwyer, Head of Finance, Water, Environment, Climate Action and Emergency Services empathised with the applicants concerned and said Leitrim County Council is obliged to follow the Credit Policy and do not have a capacity to go beyond this.

 

Councillor Mary Bohan proposed that a letter issue to the Department asking if there can be any flexibility applied in such cases. The members agreed to this proposal.

I call on Leitrim Co Council to provide a report on how they currently handle the derelict buildings register in the County and in particular buildings within our towns that neighbouring businesses may purchase to enhance and expand their present business premises.

"Leitrim County Council maintains a Derelict Sites Register in accordance with the requirements of the Derelict Sites Acts. Any building which is brought to the attention of the Planning Authority is examined and if determined to satisfy the definition of being ‘derelict’ is actioned upon. If the building is considered to be derelict as opposed to vacant and in need of minor repairs, the Planning Authority notifies to the owner (and occupier if relevant) of our intention to include the subject structure on our Register. We also issue an Improvement Notice which specifies the actions required to prevent the building from being considered ‘derelict’. In many instances, these works are undertaken, and the Planning Authority do not subsequently include the structure on the register. To date, Leitrim County Council have not sought to impose penalties with respect to a 3% valuation of the individual properties' value per annum for the buildings listed on our Derelict Sites Register.

 

The Planning Authority is presently undertaking a review of the Derelict Sites Register in conjunction with the requirements of the Vacant Sites Register as part of our agreed Work Programme for 2020. The review of the County Development Plan is also part of this process whereby specific buildings or clusters of buildings in the centre of some of our larger towns can be identified as being in need of regeneration. This review may result in some buildings being included in the Vacant Sites Register where the financial penalties are more severe and it may prove more effective than reliance on inclusion in the Derelict Sites Register. A building can only be listed on either the Derelict Sites Register or Vacant Sites Register but not on both. 

 

The inclusion of a building on either register does not confer any change to the ownership of these buildings and the acquisition of neighbouring properties by adjoining property owners is primarily considered a private matter."

New Area Offices in Manorhamilton - Councillor Sean McDermott:

Is it possible, that when the new Leitrim County Council area offices in Manorhamilton are up and running, to have space provided for staff members who reside in North Leitrim and may wish to work from these offices.The issue is very relevant at this time, because of Covid-19 many staff members are working from their homes.This arrangement may be possible for at least a few days a week.

Councillor Sean McDermott said he hoped that this could be facilitated as it would be good for the economy and for the environment and it would make sense to have some staff working from Manorhamilton when they are from the area and he sought an update on the new area offices in Manorhamilton.

Councillor Des Guckian queried if the District Engineer’s office in Mohill could be put back in operation.

 

Ms Mary Quinn confirmed that the new offices in Manorhamilton are at legal stage and that the former Mohill District office is currently in use by Mohill Library.

"The Council maintains contact with the owners of the Carrick Campus.  The well recognised potential for this facility coupled with its suitability for some flexible office accommodation arising now in what will be new work practices is shared by all and every effort will continue to secure additional investments for the space."

 

Councillor Finola Armstrong said space is now the new need.  Schools may need extra space in a couple of months, but every effort should be made to find a new business for the premises.  This facility has to be used and should not be empty from September. 

 

Councillor Enda Stenson, Councillor Sean McGowan and Councillor Paddy Farrell supported the motion.

 

Mr Joseph Gilhooly, Director of Services for Economic Development, Planning, Environment and Transportation said Leitrim County Council has pursued and continues to pursue this matter with the owner.

"Leitrim County Council collected €52k during the 2019 financial year in the application of the 75% Commercial Rates Vacancy Refund Scheme. While it is not possible to accurately break down the detail per Municipal District, I can confirm that over 80% related to the Carrick on Shannon MD area."

 

Councillor Ita Reynolds Flynn noted businesses have to decommission in order not to have to pay the 25% rate levy.  Councillor Ita Reynolds Flynn sought clarification if a business does not open before the date will the owner have to pay the 25% rates and if the 25% rates levy could be waived until Christmas.

 

Councillor Felim Gurn supported the motion.

 

Councillor Enda McGloin referred to the implications that social distancing guidelines have for businesses. He referred to a business in Drumshanbo that was viable before COVID but is not going to reopen due to the social distancing requirements.

 

Councillor Finola Armstrong McGuire queried what level occupancy has Leitrim County Council achieved on vacant premises since the introduction of the 75% Commercial Rates Vacancy Refund in respect of rateable vacant properties in County Leitrim.

 

Councillor Brendan Barry queried as to when a business can apply for a restart grant.

 

Mr Vincent Dwyer, Head of Finance, Water, Environment, Climate Action and Emergency Services said any business can apply for the restart grant until the 31st August 2020. The 25% Commercial Rates Levy is part of the budgetary process for 2020 which was adopted. This cannot be revisited for 2020. It can certainly be considered before the November Budget meeting.

 

Councillor Ita Reynolds Flynn said she was very disappointed with the answer regarding the 75% Commercial Rates Vacancy refund and said that business people are under a lot of pressure.

 

Mr Lar Power, Chief Executive acknowledged the points raised and said the purpose of the 75% Commercial Rates Vacancy refund scheme is to bring in a new culture aimed at regenerating our towns and villages.  The Government has granted a 3-month waiver on Commercial Rates and Leitrim County Council are awaiting further clarification from Central Government in this regard.

 

Cathaoirleach, Cllr Mary Bohan proposed that a letter issue to the Government for further clarification on this issue as a matter of urgency.

Obsolete Rail Line - Councillor Enda Stenson:

That Leitrim County Council contact Bord Na Mona about the possibility of obtaining the obsolete rail line that they are lifting. This could be used in future to connect Dromod station to Mohill station.

Councillor Enda Stenson said Tourism has great potential in Leitrim and this project should be seriously considered. This project would be great for Mohill, Lough Rynn, Dromod and the surrounding areas.

 

Cathaoirleach, Councillor Mary Bohan queried if Bord Na Mona could donate this to Leitrim County Council.

 

Councillor Des Guckian outlined his view that this was a “pie in the sky motion”.

 

Councillor Paddy O’Rourke said this material will be lifted and let deteriorate and then put up for sale at a later date and sold off for a “song”.

 

Mr Joseph Gilhooly, Director of Services, Economic Development, Planning, Environment and Transportation said that in the absence of a private led initiative it would be premature to progress with this project.

"The review of the County Development Plan 2015-2021 and the preparation of the new County Development Plan for the period 2022-2028 commenced formally on Wednesday 17th June with the publication of our notification of intention to review the existing County Development Plan and to prepare a new County Development Plan. The first phase of the process is the pre-draft consultation stage where the Planning Authority prepares a background document, titled 'Strategic Issues Paper' which provides a summary of the range of strategic issues facing the county at present, seeks to stimulate debate and encourage people to become involved in the plan making process. The Planning Authority are also obliged to hold public consultation events during this 8-week period but these cannot be confirmed at this time owing to the public health measures which continue to be in effect. Submissions can be made to the Planning Authority on the strategic policy content to be contained in the new County Development Plan before 4.30 p.m. on Wednesday 12th August 2020. The one exception to the nature of submissions which can be made at this stage is that no submission seeking to have land zoned or to change the current zoning on any land can be considered at this time. Landowners will have one such opportunity following the publication of the draft County Development Plan in approximately 12 months’ time. The Planning Authority have provided extensive details of the roadmap in the documentation which was submitted to the Elected Members on Tuesday 16th June last in addition to the information now contained on our website."

 

 

Councillor Frank Dolan noted that a road map had been circulated from the Planning Authority in relation to the review of the County Development Plan 2015-2021.  Councillor Frank Dolan said that when the new County Development Plan is being drawn up something much stronger to have included in plan in relation to one off rural housing is essential as this is now more in need due to the COVID pandemic.

 

Councillor Enda McGloin supported the motion and said he did raise this issue with members who were involved in negotiating the formation of the new Government.

 

Cathaoirleach, Councillor Mary Bohan said all members want a change in this regard.

 

Councillor Padraig Fallon proposed that Leitrim County Council correspond with every local authority to see if this is an issue with them as Leitrim County Council needs to build alliances with other counties in this regard.

 

Councillor Justin Warnock said that a lot of thought needs to be given to this issue.

Restart Programme - Councillor Paddy O'Rourke:

I ask Leitrim County Council are there any plans to include Guesthouses and B&B’s in the Restart programme in this County following the COVID-19 crisis. Many of these small businesses contribute greatly to the local economy by means of providing full and part time employment along with the contribution of their patrons to the local economy.

"Leitrim County Council are administering the Restart Grant Scheme in line with the criteria set out in the service level agreement with two Government departments. Guesthouses and B&B's are eligible for the scheme provided they are a "Qualifying Business" which requires that the property is rateable and trading. Leitrim County Council has already processed applications in this regard."

 

Councillor Paddy O’Rourke said Guesthouses and B& B’s are traditionally seasonal and they have not been asked to pay rates and are excluded from the restart grant.

 

Mr Vincent Dwyer, Head of Finance, Water, Environment, Climate Action and Emergency services said the restart grant is administered in line with the criteria set out in the Service Level Agreement by two Government Departments.  Mr Dwyer said Leitrim County Council have no basis to validate an application if business has not got a rates number.  Mr Dwyer advised that this issue should be taken up with Fáilte Ireland to lobby on behalf of B&B’s and Guesthouses.

 

Councillor Brendan Barry sought clarification on the following:

 

·         Is an owner of a building with multiple occupancies entitled to the scheme?

·         what date must a business reopen on to avail of restart grant

 

 

Mr Dwyer advised that business owners should contact the Finance Department of Leitrim County Council if in doubt and once committed to reopening they should make an application for a restart grant.

 

Mr Lar Power acknowledged that he fully accepts the issue regarding B&B’s and guesthouses but Leitrim County Council have to comply with the set of rules made by the Department. 

 

Cathaoirleach, Councillor Mary Bohan highlighted that lobby groups should raise this issue through the Department.

 

Councillor Paddy O’Rourke proposed that the Head of Finance liaise with his counterparts in other local authorities in this regard.  Mr Dwyer agreed to this request.

That Leitrim Council explore avenues of providing grants and support to farmers in Leitrim that now need to invest in technology to efficiently run their farms.

With Mart sales now taking place on line it's vital that farmers of all ages and locations have the necessary equipment and skillset's to enable them to participate when it comes to online sales.

The local authority should consider as a matter of urgency providing grants for equipment such as laptops and tablets. The Council should also explore and engage with local companies that can provide basic training for farmers to get them established on line.

"The primary training and developing agency to support the farming sector is Teagasc who provide a variety of services.  It would therefore be relevant for the Council to identify this need to Teagasc.  The Council is also in the process of developing a Digital Strategy part of which will focus on the need to continue to assist all sections of the community in becoming more on-line enabled.  Any courses or tuition concepts that arise from this strategy, when finalised, would be open to all sectors to take part."

 

 

Councillor Paddy Farrell welcomed the response and asked that the invitation would be sent to all farmers not just Teagasc members.

 

Councillor Sean McGowan proposed that the LEO office should come on board in this regard.

 

Councillor Enda McGloin proposed that a letter issue to Leitrim Development Company to co-ordinate this and bring farmers the necessary skillset.

Everybody’s credit in the world economy is in a mess and businesses will struggle to get employees back unless more support is given.

Councillor Mary Bohan outlined that the broadband service is unsatisfactory and measures should be implemented immediately for the provision of a high speed broadband for students doing assessments and homework online and people working online from home.  This is an essential service which is just as important as the ESB Service.

 

Mr Joseph Gilhooly advised Members that the Broadband Officer is engaging with communities in this regard and he confirmed Drumkeeran is fully operational by the EIR rollout with less than 20 households to be connected.

 

Councillor Padraig Fallon said that a number of households in the village are unable to avail of the service as of last week.

 

Councillor Des Guckian supported the motion.

 

Councillor Justin Warnock said most of the village in Kinlough is unable to get broadband and this is not good enough for a village which has a school of 300 students.

I would like to put forward a motion to ensure that this money is directed to farmers and not to factory feed lots. Also a new reps style environmental scheme has been included in the new programme for government. This scheme needs to be more suitable for the west of Ireland than the GLAS and AEOS schemes. It needs to be more like the old Reps Scheme. Restrictions on when you can mow rushes and when you mow meadows do not suit the land in County Leitrim. Farmers have to be able to carry out these works when the ground is dry.

Minutes:

Councillor Felim Gurn proposed that the elected members of Leitrim County Council call on the Minister for Transport Tourism and Sport to ensure that the required funding is included in any upcoming economic stimulus package and in the National Development Plan to ensure the completion of the SLNCR greenway, as outlined in the Programme for Government within the lifetime of the current government.
