CMD.113.23   Adoption of Minutes of Carrick Municipal District Meeting of 11th September 2023

 

On the PROPOSAL of Councillor Thomas Mulligan

             SECONDED by Councillor Paddy Farrell

 

Cllr Des Guckian requested the following amendment to CMD105.23 change the road number from L501 to L1601.

 

It was AGREED to adopt the minutes of the meeting of 11th September 2023 with the amendment as proposed by Councillor Guckian.

Meeting Correspondence

Minutes:

The following correspondence was noted by the members:

 

  1. Reply to Cllr Des Guckian regarding installation of lift at Dromod Railway Station.

 

Councillor Des Guckian queried had Iarnród Éireann replied directly to Leitrim County Council.

 

Mr Kieran Brett informed Cllr Des Guckian no direct response was received.

 

Councillor Des Guckian referred to the reply he received from Iarnród Éireann and said it did not seem to offer a possible timetable for the installation of a lift. He stated a follow up letter should be issued to Iarnród Éireann requesting the installation of lift at Dromod Railway Station as a priority and for it to be installed by June at the latest.

 

Councillor Sean McGowan advised Dromod Station is on the list and the lift will be installed in due course, however, planning has not been submitted yet.

 

 

  1. Letter from Mandy Doyle of HSE regarding pertaining physiotherapy services in Mohill.

 

Cathaoirleach Councillor Enda Stenson acknowledged the reply.

 

Councillor Des Guckian queried has any appointment been made or is there any more information in respect of this.

 

Mr Kieran Brett replied that no further information had been made available to Leitrim County Council.

 

CMD.115.23

Consider the General Municipal Allocation for 2024 for the Carrick-on-Shannon Municipal District

Minutes:

Mr Vincent Dwyer, Head of Finance,Water, Environment, Climate Action and Emergency Services gave a report on the Budget 2024 process and the General Municipal District Allocation for the Carrick-on-Shannon Municipal District as set out in Appendix 1 to the minutes of this meeting.

 

Cathaoirleach Councillor Enda Stenson welcomed the increase in funding whilst acknowledging we must work within the confines of what has been allocated.

 

Councillor Finola Armstrong-McGuire highlighted that in estates where the Local Authority owns social houses, there is an issue where some tenant’s do not pay the annual contribution to the Resident’s Association which helps to maintain the estates. She queried if this matter could be considered by the Housing Department of the Council and asked that it be resolved before the end of the year.

 

Cathaoirleach Councillor Enda Stenson concurred and highlighted the fee been requested by resident’s associations within these estates is not a considerable amount.

 

Councillor Des Guckian noted the GMA report was in draft format and expressed his opposition to the General Municipal Allocation for Carrick on Shannon Municipal District.  He expressed disappointment at the small sum of money allocated to the Carrick Municipal District and highlighted there was no allocation for river drainage. 

 

Councillor Thomas Mulligan queried was there any funding allocated to the maintenance of the river in Mohill.  He advised this issue was discussed at a previous meeting, and he had requested that funding be ringfenced for this purpose.

 

Mr Vincent Dwyer informed the members river drainage doesn’t form part of the General Municipal Allocation. River Drainage issues will be addressed at the main budget meeting.  He advised the members that the report sets out legislative basis for the General Municipal Allocation, which is applicable to all local authorities.

 

Councillor Sean McGowan welcomed the small increase in funding, acknowledging it will help Tidy Towns and other community groups.  He acknowledged that the allocation for River Drainage goes before the main budget meeting and queried if the flood relief scheme proposed for Mohill will address maintenance issue on the river.

 

Councillor Thomas Mulligan stated flooding isn’t a significant issue and he reiterated that specific funding be allocated for the maintenance of the river in Mohill which will be an ongoing issue.

It was AGREED that the General Municipal District Allocation for the Carrick-on-Shannon Municipal District in accordance with Section 102(4A)(a) of the Local Government Act 2001 (as amended by the Local Government Reform Act 2014) be approved.

Consider the CE's Report in respect of the creation of a permeability link between Cara Court Estate, Glen Carrick Estate and Aura Leisure.

Pursuant to Section 179 of the Planning & Development Act 2000 (as amended) and Part 8 of the Planning & Development Regulations 2001 (as amended)

Minutes:

Cathaoirleach Councillor Enda Stenson welcomed the creation of the permeability link between Cara Court Estate, Glen Carrick Estate and Aura Leisure stating it was seen as a need by people in the area.

 

Councillor Finola Armstrong-Maguire concurred and acknowledged the engagement that had taken place with people living in the area and noted it will be a good link to have in place.

 

Councillor Des Guckian expressed his concern about the creation of the link.  He raised the following points.

 

  • The map provided in the report is vague.
  • Is the link for pedestrians only or are cyclists included?
  • The link doesn’t take account of the settlement in Cara Court, there are a number of disabled or elderly people living there.
  • This link may give rise to anti-social behaviour.
  • People will be made prisoners in their own homes.

 

Councillor Des Guckian stated if the consideration of the residents of Cara Court Estate are not taken into account, he will oppose the development.

It was AGREED pursuant to Section 197 of the Planning and Development Act 2000 (as amended) and Part 8 of the Planning and Development Regulations 2001 (as amended) the creation of a permeability link between Cara Court Estate, Glen Carrick Estate and Aura Leisure be approved.

Update on Broadband rollout

Minutes:

Ms Nicola McManus delivered a presentation to the members on the broadband rollout in the county as set out in Appendix 2 to the minutes of the meeting.

 

The members raised the following points;

 

  • When is it expected that that National rollout will be delivered to Leitrim?
  • The Hive & Enterprise Centre are tremendous facilities, and the quality of service is excellent.
  • What connection costs and service charges will be placed on households.
  • What recoupment will volunteers receive for duties carried out in community run Broadband Connection Points.
  • If we have paperless meetings, there is no record. It is important there is a paper trail.
  • Once surveys are completed in a locality, what is the time lag until fibre broadband is rolled out, available to households.
  • Broadband rollout works on the Mohill-Cloone road were queried.

 

Ms Nicola McManus informed the members the broadband rollout is scheduled until the end of 2026. The NBI website has a facility that allows individuals to check the installation date for their address using either a map or Eircode search.

 

Fibre is being laid on currently on the Mohill-Cloone road. Contractors working for NBI are carrying out works to provide a connection for that rural area by providing infrastructure to allow connectivity.

There is no payment for volunteers who operate the community centres or hubs that host a Broadband Connection Points. Broadband connection costs and charges at these Broadband Connection Points are paid for by the Local Authority.

 

Mr Justin Fannon informed the members charges will be determined by service providers rather than by National Broadband Ireland who will install the infrastructure.  It is a matter for each broadband service provider to set charges based on the level of service and speeds they provide, and households will have to decide what service provider and package will best meet their own needs.

 

Councillor Des Guckian highlighted households getting National Broadband service will be at the mercy of the service providers.

Motion from Councillor Des Guckian - Traffic speed on R201

That our engineers be asked, in the interests of road safety for all, to bring in a variety of new measures to curb the speed of traffic, on the R201, especially coming from the Carrick side, in advance of its junction with Cornee Lane L34481. The residents are very concerned that there will be a major accident here and they know that there have been some near misses in recent times.

Minutes:

To consider the following Notice of Motion submitted by Councillor Des Guckian;

 

"That our engineers be asked, in the interests of road safety for all, to bring in a variety of new measures to curb the speed of traffic, on the R201, especially coming from the Carrick side, in advance of its junction with Cornee Lane L34481. The residents are very concerned that there will be a major accident here and they know that there have been some near misses in recent times."

 

Report by Roads - General

"The local authority have appropriate speed limits located along the R201 prior to this junction and have recently erected a driver feedback sign also. The issue is now an enforcement issue, and the elected member should bring this up at the next JPC meeting."

 

Councillor Des Guckian gave background to his motion.  He requested the introduction of additional signage, rumble strips and other measures to curb the speed of traffic.

 

Councillor Thomas Mulligan supported the motion and highlighted the line of sight at the junction is a problem and hedge cutting alone is not sufficient to address this.

 

Councillor Paddy Farrell and Sean McGowan also supported the motion.

 

Mr Darragh O’Boyle agreed with Councillor Des Guckian and said rumble strips can be introduced at the location and agreed that “speed traps” are necessary and this matter should be raised at the next JPC meeting.  He advised he will write to the landowners to ensure hedges are cut to improve lines of sight.

 

Councillor Des Guckian thanked Mr Darragh O’Boyle and the elected members for their support on this matter.

Motion from Councillor Des Guckian - Mohill Dump

That Council officials be asked to explain, in some detail, about how seepages from the old Mohill dump are handled and made safer. What exactly does the EPA licence cover and is it allowing noxious and dangerous effluents to go downstream into Lough Rinn and onwards to Lough Forbes, which provides drinking water for Co Longford?

To consider the following Notice of Motion submitted by Councillor Des Guckian;

Report by Head of Finance & Water Services

"The waste mass at Mohill closed landfill is capped so surface water does not enter the waste volume but runs of the landfill into the surface water network and onto the river.

Under the landfill capping layer and within the waste mass are drainage pipes that collect and transfer the leachate (the wastewater from the decomposing waste) into the leachate network and on into the leachate collection chamber manhole adjacent the landfill and Civic Amenity Site. From this collection chamber the leachate flows by gravity onto the Knocklongford pumping station and then pumped to the Mohill Wastewater Treatment Plant.

A CCTV survey undertaken on 1st March 2022 confirmed the leachate line at Mohill Closed landfill is discharging by gravity to the public sewer and that it is piped completely separately to the Surface Water pipeline at this landfill. The Survey also confirmed that there is no connection between the leachate network and the river and therefore no discharge of leachate into the Rinn river.

The EPA granted Leitrim County Council a Waste Licence for the closure, restoration, and aftercare of Mohill Landfill in January 2002. The EPA Waste Licence for Mohill Landfill provided the structure for the restoration and aftercare works required by the EPA.

Leitrim County Council prepared the designs and Method Statements for the restoration works in accordance with the Waste Licence and EPA Code of Practice. These designs were approved by the EPA prior to commencement of works. The design included an engineered piped leachate collection system around the landfill which is connected to the Knocklongford wastewater pump station from where the leachate is pumped forward for treatment at Mohill wastewater treatment plant.

This EPA Waste Licence for Mohill Landfill also requires that Leitrim County Council carry out an extensive suite of biological and physico-chemical monitoring and analysis on a monthly/quarterly basis. The licence sets emission limit values for these parameters. All emissions from the Landfill continue to be monitored in accordance with the EPA Waste Licence. It is a condition of the licence that all monitoring results are reported, and an Annual Environmental Report (AER) is submitted each year. This AER is a summary report of the environmental information for a given year.

Since the closure of this landfill and based on the monitoring results and reducing levels of emissions from the landfill over the intervening years, the EPA did agree to reduce the monitoring frequency for both storm water and groundwater in the Waste Licence for Mohill Landfill. Motion from Councillor Sean McGowan - land owned by Goodman Group

The lands owned by the Goodman Group in Dromod remain unused. Can the Goodman Group be contacted to seek their comments on their intentions to bring the land back into beneficial economic use for the area.

It was AGREED to write to the Goodman Group to seek their comments on their intentions to bring the land back into beneficial economic use for the area.

 

Councillor Des Guckian queried had Councillor Sean McGowan or local committee contacted the Goodman Group or made any contact with Mr Goodman.

 

Councillor Sean McGowan advised Councillor Des Guckian he has met with Mr Goodman on several occasions, however, the matter has not progressed.

Motion from Councillor Sean McGowan - Road Antfield to Finnalaghta Road No. L-7472-0

I ask Mr Darragh O’Boyle, District Engineer to include the section of road on the Antfield to Finnalaghta Road No. L-7472-0, that was cut from this year’s road works programme in the 2024 roadworks scheme. The local community were annoyed and angered over the decision to only do half the planned works.

To consider the following Notice of Motion submitted by Councillor Sean McGowan;

 

"I ask Mr. Darragh O’Boyle, District Engineer, to include the section of road on the Antfield to Finnalaghta Road No. L-7472-0, that was cut from this year’s roadworks programme, in the 2024 roadworks scheme. The local community were annoyed and angered over the decision to only do half the planned works."

"We can submit this road for inclusion in the next 3-year programme."

 

Councillor Sean McGowan welcomed the works that have been completed on the first section of the road and queried could the remaining part of the road be completed.

 

Cathaoirleach Councillor Enda Stenson supported the motion.

 

Councillor Des Guckian agreed with Councillor Sean McGowan sentiments and queried why the planned works were halved and questioned how Mr Darragh O’Boyle changed his opinion after committing to have the works completed.

 

Mr Darragh O’Boyle informed the members the 3-year road programme is always indicative.  There is a specific budget for each road in the Annual Road Works Programme, and the road in question was in poor condition and required significant works.  He advised the remaining section of road can be submitted for inclusion in the next 3-year road programme. The road in question is 2.4km long.  Mr Darragh O’Boyle said he will consider if the road is suitable for other funding schemes such as Climate Action funding. He highlighted to members there is never a guarantee that we can complete 1km of length of road as planned in the Annual Road Works Programme as costs are variable and subject to inflation.

 

Cathaoirleach Councillor Enda Stenson supported the motion.

 

Councillor Des Guckian expressed his amazement that Mr Darragh O’Boyle cannot assess costs in advance as this would eliminate issues such as this where sections of roads cannot be completed.

 

Mr Darragh O’Boyle advised that the Annual Roads Programme and budgets are set and approved by the members.  The 3-year road programme put forward indicative lengths of road restoration for members’ approval.  It is not possible to know the full extent of the costs of work in advance of works commencing.  Mr Darragh O’Boyle wrote to the adjoining households on the road and informed them that if they have the water catchment system in place at their entrances (in accordance with their planning permission), Leitrim County Council would blacktop to that catchment point. Some of the householders had completed this work and Leitrim County Council blacktopped up to their drive entrance. This is an additional cost to the grant and would reduce the overall blacktop coverage of the public road.

Motion from Councillor Finola Armstrong McGuire - pathway from Glen Carraig up to Summerhill

Can the Carrick-on-Shannon area engineer, Mr. Darragh O’Boyle, please look at the pathway from Glen Carraig up to Summerhill. Cyclists are not dismounting as they should, and are a danger to themselves, pedestrians, other cyclists and vehicle drivers. It would be a safety improvement to erect a barrier of some type to ensure cyclists walk through this pathway.

"Can the Carrick-on-Shannon area engineer, Mr. Darragh O’Boyle, please look at the pathway from Glen Carraig up to Summerhill. "The district office can erect a kissing gate at the lower end of the connection walkway. We will programme these works for the first quarter of 2024."

 

Councillor Finona Armstrong-McGuire acknowledged the reply given and was glad to see gates been considered.  She queried in the meantime is there any signage that can be reused to instruct cyclists to dismount.  She highlighted it is a safety issue.

 

Mr Darragh O’Boyle stated these works should be completed in the first quarter of 2024 or possibly alongside thedevelopment of the permeability link between Cara Court Estate, Glen Carrick Estate and Aura Leisure as approved at this meeting.

Motion from Councillor Finola Armstrong McGuire - Improvement works at bus stop opposite Landmark Hotel

The works at improving the bus stop opposite the Landmark Hotel are clearly over running the time anticipated. Can I have an outline of the cause of the delay. The state in which the area has been left during the delay is a cause of concern, as the safety of the public is totally ignored.

To consider the following Notice of Motion submitted by Councillor Finola Armstrong-McGuire;

 

"The works to improve the bus stop opposite the Landmark Hotel are clearly over running the time anticipated. Can I have an outline of the cause of the delay.

The state in which the area has been left during the delay is a cause of concern, as the safety of the public is totally ignored."

 

Report by Capital Projects Office

"The main cause of the delays to the project are due to the presence of an underground electricity cable through the site. The records of the existing services did not show power cables going through the site. The diversion of this cable did take time as the ESB had to upgrade sub stations in Cortober and Carrick on Shannon before they could divert the cable off the bus stop site.

 

The safety of the general public has not been ignored. The site has been cordoned off to prevent access. The public footpath had to be closed down and pedestrians were signed to cross the road to continue.

 

The electricity cable work has been completed and our contractor has returned to site. We estimate that work will be completed before year end."

 

Councillor Finola Armstrong-McGuire highlighted the way the area has been left is a serious safety issue.  She acknowledged the Health and Safety measures in place outside the Council buildings are very good, as opposed to what is at the bus stop area presently and this area needs to be reviewed by the Health & Safety officer.  She expressed her concerns over the poor level of safety shown to people using the walkway.

 

Councillor Paddy Farrell, Councillor Sean McGowan and Cathaoirleach Councillor Enda Stenson supported the motion.

 

Mr Justin Fannon informed the members he will ask the Health and Safety Officer to revisit and review the Health and Safety measures in place.

Motion from Councillor Paddy Farrell - Repair access and pathways leading to houses in St. Patrick's Park, Breffni Heights and Breffni Crescent

I call on Leitrim County Council and Head of Finance, Mr. Vincent Dwyer, to allocate and find funding to repair the very dangerous access and pathways leading to houses in St. Patrick’s Park, Breffni Heights and Breffni Cresent as they are in a very dangerous state.

Minutes:

To consider the following Notice of Motion submitted by Councillor Paddy Farrell;

 

"I call on Leitrim County Council and Head of Finance, Mr. Vincent Dwyer, to allocate and find funding to repair the very dangerous access and pathways leading to houses in St. Patrick’s Park, Breffni Heights and Breffni Cresent as they are in a very dangerous state."

 

Report by Roads - General

"Limited funding to specifically cover the essential repairs of substandard footpaths in taken in charge estates is currently being established.  The section of footpath is currently closed on health and safety grounds but will be upgraded once this specific funding is available."

 

Councillor Paddy Farrell acknowledged the reply and requested clarity on why the section of the footpath is currently closed.

 

Mr Darragh O’Boyle informed the members that he and Councillor Paddy Farrell examined the footpaths in the area and subsequently agreed to patch and clean some footpaths.  When the mini sweeper was cleaning this specific section of the footpath, the condition of the path deteriorated significantly, and on health and safety grounds, it was decided to close the footpath.  Mr Darragh O’Boyle advised there is currently no funding available to carry out the required repairs, however, as soon as we receive funding, the footpath will be prioritised for repair.  He acknowledged there is a need to establish new footpaths in the area, however, there are no visible potholes on the road network.

 

CathaoirleachCouncillor Enda Stenson queried how likely it will be to receive funding to enable repairs to be carried out.

 

Mr. Justin Fannon informed the members there is limited funding available through a rebate from IPB which is to be used specifically to address substandard footpaths that have the potential to lead to public liability claims.  He advised that the funding will be available in the coming weeks and that he has been in contact with the District and Housing engineers to compile a list of footpaths that most meet this criteria

 

Mr Darragh O’Boyle advised footpath repair funding cannot be sourced from the Active Travel grant. This money is allocated for the creation of new footpaths to create links from suburban to urban areas and thereby encourage people to get active through walking or cycling.

 

Councillor Paddy Farrell asked that funding be made available as soon as possible to address this issue.

 

CMD.125.23

Motion from Councillor Paddy Farrell & Motion from Councillor Thomas Mulligan - resurfacing works at Ohill cross

Following the completion of the recent road resurfacing works at Ohill cross, I request Leitrim County Council and District Engineer, Darragh O Boyle, to tar or blacktop additional sections of road each side of Ohill cross as the new surface highlights the poor condition and unevenness of these sections of road, which is now in need of urgent attention.

Minutes:

It was agreed by the Members that Motion Number 13 in the name of Councillor Paddy Farrell and Motion Number 17 in the name of Councillor Thomas Mulligan be taken concurrently as they relate to the same issue.

"The 3-year roads programme has the next section towards Keshcarrigan scheduled for 2024."

 

To consider the following Notice of Motion submitted by Councillor Thomas Mulligan;

 

"I am asking that further attention be given to recent road strengthening works at Ohill crossroads on the Keshcarrigan / Mohill road."

 

Report by Roads - General

"The recycled road strengthening works are now complete and we are satisfied with the end product. I am unaware of any further attention that is required."

 

Councillor Paddy Farrell complimented Mr Darragh O’Boyle and his team on the resurfacing works completed recently at Ohill cross and queried could additional improvement works be carried out either side of Ohill cross where works been completed.

 

Mr Darragh O’Boyle informed the members this section of the road was completed as a recycling job as we are trying to introduce low carbon measures in maintaining our infrastructure.  He advised the members that the road will settle in time and stated there is no road restoration grant this year, for the remainder on this road.

 

Councillor Sean McGowan welcomed the road improvements completed to date.

 

Councillor Thomas Mulligan highlighted there are undulations in the Keshcarrigan/Mohill road after the contractor surfaced the road with blacktop.  He requested the contractor be asked back to address this, however, he did acknowledge the substantial improvement in the road.

 

Mr Darragh O’Boyle informed the members a restoration grant has been approved for the Keshcarrigan side of Ohill cross and he hopes this work will be carried out next year.  He stated there is only funding available to complete the Keshcarrigan side.

Motion from Councillor Enda Stenson - Hartley Group sewage scheme

I ask that the elected members of this Municipal District are given an update on the up to date position on the ongoing saga, that is Hartley Group sewage scheme.

"I ask that the elected members of this Municipal District are given an update on the up-to-date position on the ongoing saga, that is Hartley Group sewage scheme."

 

Report by Head of Finance & Water Services

"Consultants have been appointed to re assess the construction costs of the scheme and this process is ongoing."

 

CathaoirleachCouncillor Enda Stenson acknowledged the response.  He queried were commitments given to Hartley’s Resident Association as the group sewage scheme does not seem to have progressed any further since the last meeting with the residents’ association.

 

Mr Justin Fannon informed the members there was an issue procuring a consultant initially, but consultants have now been appointed and they are undertaking the work.


Cathaoirleach Councillor Enda Stenson requested this issue to be discussed at the next meeting of Carrick municipal district.  He highlighted there is an issue concerning septic tanks and grants for septic tanks which needs to be addressed.

 

Councillor Sean McGowan supported the motion.  He reiterated that the consultant’s report needs to be completed.  He highlighted it is a serious issue and expressed his wish that funding will be provided to progress the scheme.

 

Councillor Finola Armstrong-McGuire supported the motion and acknowledged the committee have done their best.  She concurred there needs to be substantial grants for septic tanks.

 

Councillor Des Guckian highlighted how the local committee have put significant effort and incurred costs into developing a scheme for their area and it has not progressed.  The local committee has been let down by the process and left with significant costs and this needs to be addressed.

Motion from Councillor Enda Stenson - Trees at Funsinagh cross on Mohill/Keshcarrigan road

I ask district engineer, Mr Darragh O’Boyle, to examine solutions to deal with two trees at Funsinagh cross on the Mohill /Keshcarrigan road, as they are blocking the view crossing this junction.

"The district Office will, once again, write to the landowner and advise him that he needs to take action regarding hedges and trees."

 

 

Councillor Sean McGowan supported the motion.

 

Mr Darragh O’Boyle advised he had met with the landowner previously and the landowner agreed to fell the trees.  He advised the district office will write to the landowner again and advise him to act regarding the trees and hedges.  Leitrim County Council will assist the  landowner with signage and traffic management, however, it is the landowners responsibility and Leitrim County Council cannot enter onto someone’s private property and cut down the trees without giving him formal notice.

 

CathaoirleachCouncillor Enda Stenson highlighted there are numerous large decaying ash trees in the county which are a danger, and an eyesore and funding needs to be made available to help landowners remove these decaying trees.

 

Councillor Sean McGowan agreed with Cathaoirleach Councillor Enda Stenson comments.

 

Mr Darragh O’Boyle advised members the Department of Transport will give a similar answer to what he has advised the members today. 

 

CathaoirleachCouncillor Enda Stenson reiterated farmers will not be able to address the issue of decaying ash trees on their own.

Motion from Councillor Thomas Mulligan - Manhole at Station Road/Coolabaun Mohill

I am requesting that a manhole situated at Sation Road / Coolabaun Mohill, which during heavy rain, is continually flooding the road and a nearby field, is examined for a blockage or defects.

"I am requesting that a manhole situated at Station Road / Coolabaun Mohill, which during heavy rain, is continually flooding the road and a nearby field, is examined for a blockage or defects."

"The district office will seek all drainage pipes to be surveyed and cleaned once the urban renewal works are completed."

 

Councillor Thomas Mulligan requested the manhole be examined for blockage or defects.  He expressed his concern stating the manhole lifts during periods of heavy rainfall and is a danger in the road.  Excess water is going into a nearby field and flooding it. He stated this issue cannot be left unattended until urban renewal works commence.


Cathaoirleach Councillor Enda Stenson supported the motion.

 

Mr Darragh O’Boyle informed the members the district office will contact Irish Water and advise them the manhole which is under their responsibility is becoming a hazard.
