Adoption of Minutes of 11th July 2022

It was AGREED to adopt the Minutes of 11th July 2022.

 

 

Councillor Des Guckian queried when correspondence will be issued from the Executive in regard to the Approved Housing Bodies as agreed at the 11th July 2022 Carrick on Shannon Municipal District meeting.

 

Mr Joseph Gilhooly confirmed that this information was already issued to Cllr Guckian on the 9th August 2022,  by email from the Senior Executive Officer in Housing Capital.

Consider the CE's Report on the Part 8 planning proposal for footpath and public lighting on the L-1601 at Rooskey

Minutes:

The Chief Executive’s Report and Recommendation pursuant to Section 179 of the Planning & Development Acts 2000 (as amended) and Part 8 of the Planning & Development Regulations 2001 (as amended) as circulated to the Members.

 

 

Nature, Extent and Location of Development

 

Leitrim County Council is proposing to construct a footpath with public lighting on the

L-1601 traversing the townlands of Moher, Knockmacrory and Killinaker at Rooskey. The proposed 2 metre wide footpath is located on the western side of the road for a length of 340 metres. 11 No. 4 metre high lighting poles are proposed to be erected along the footpath. The proposed development will directly serve residents and visitors by providing safer walking infrastructure and will aid in reducing the speed of vehicles.

 

 

On the PROPOSAL of Cllr. Finola Armstrong McGuire

            SECONDED by Cllr. Paddy Farrell

 

It was AGREED that Leitrim County Council proceed with the works in accordance with the approved plans.

 

Councillor Des Guckian expressed his disappointment with the maps, and he said there was no clear reference points on the maps such as a factory that is near the proposed location.

 

Cathaoirleach, Councillor Sean McGowan said he had no problem with the map in respect of the proposed development.

 

CMD.111.22

Agree date of October & November meetings of Carrick-on-Shannon MD

Minutes:

Mr Kieran Brett proposed the following dates for MD meetings:

 

·       October meeting of Carrick on Shannon Municipal District will take place on Monday, 17th October 2022 at 10 am in The Dock Arts Centre. This date falls within the prescribed period that applies for the holding of an MD meeting to consider the General Municipal Allocation.

·       Carrick on Shannon Municipal District Meeting for November will take place on the Monday, 21st November 2022 at 10 am in the Council Chamber.

·       Carrick on Shannon Municipal District meeting for December will take place on Monday, 12th December at 10 am in the Council Chamber.

 

The members agreed to these dates and times.

 

CMD.112.22

Motion from Councillor Des Guckian- Toilets be provided on the lay-bys of the Dromod-Rooskey by Pass

That toilets be provided at each of the lay-bys on the present Dromod-Rooskey by-pass and that when the new extension of this by-pass, as far as Glas na hAbhainn, is built, there be provision made for more on each side, as well as a service station on each side of the new road.

Minutes:

To consider the following Notice of Motion submitted by Councillor Des Guckian;

"The are government guidelines in place setting out planning policy considerations relating to development affecting national primary and secondary roads, including motorways and associated junctions, outside the 50-60 kmh speed limit zones for cities, towns and villages. In regard to this matter these guidelines refer to the concerns of creating significant safety risks noting too that in general sufficient roadside facilities exist on non-motorway national road network, which also passes through or is in close proximity to a significant number of urban towns and villages where facilities can be provided for in a sustainable manner. This latter point is of particular relevance to the bypass referred to.

 

Therefore, there are no plans to place toilet facilities on the Dromod Rooskey bypass. Furthermore, there is no public sewer anywhere near this location."

 

 

Councillor Des Guckian said toilets should be provided at each of the lay-bys on the Dromod-Rooskey bypass and also on the new extension of this bypass as far as Glas na hAbhainn, on both sides of the road, as these facilities are needed by motorists.

 

Mr Joseph Gilhooly referred to the national guidelines that are in place for the construction of National Primary Roads, and he said there are no plans to place toilet facilities on the Dromod Rooskey bypass.

 

Councillor Des Guckian said this was ridiculous and that allowances should be made for people that have to stop on this route when getting sick etc. and he proposed that this motion is passed onto the TII.

 

Mr Gilhooly said the passing of a resolution, to forward this motion to the TII,  is a matter for the members consideration.

 

Following a discussion, Cllr Enda Stenson agreed to support the proposal that the motion is forwarded to the TII for further consideration.

Motion from Councillor Des Guckian - Provision of a circular tarmac track at Lough Rinn

That the Council plays the leading role in the provision of a circular tarmac track, 380m long by 4m wide, at the Council-owned property at Lough Rinn, to cater for the people with disabilities who wish to join in with the orienteering group that is already active in South Leitrim.

Minutes:

To consider the following Notice of Motion submitted by Councillor Des Guckian;

 

"That the Council plays the leading role in the provision of a circular tarmac track, 380m long by 4m wide, at the Council-owned property at Lough Rinn, to cater for the people with disabilities who wish to join in with the orienteering group that is already active in South Leitrim."

"Leitrim County Council has provided a disabled Access Trail 680M in length to the Rowing Centre Spectator Viewing area and the two no Fishing Stands on the western shore of Lough Rinn which links from the existing car park at the new Lough Rinn Sewerage Treatment Plant to the Mohill to Drumlish Road (L1053) where the Rinn River 010 crosses this County Road.

 

We welcome this proposal from the Solar Orienteering Club for a looped disabled Orienteering trail through the wooded area to form a nice loop of the existing trail. There is an additional 0.5km trail to build in a wooded area and this will fit in with the future master plan for Lough Rinn and the next Part 8 Planning Permission to be submitted before year end. Once design and planning matters are in hand, we will explore future funding opportunities that may arise in the future for this proposed looped trail."

 

Councillor Des Guckian said he has received a letter from the Orienteering group with the support of the LAPWD.

 

Councillor Des Guckian acknowledged and welcomed the reply received.

Motion from Councillor Sean McGowan- Lock Estate in Rooskey

I ask Mr Joseph Gilhooly Director of Services Infrastructure, what is the update on the taking in charge of the Lock Estate in Rooskey?
There is no public lighting in the estate, and it is extremely dark for the residents who live there.

To consider the following Notice of Motion submitted by Councillor Sean McGowan;

 

"I ask Mr Joseph Gilhooly Director of Services Infrastructure, what is the update on the taking in charge of the Lock Estate in Rooskey?

There is no public lighting in the estate, and it is extremely dark for the residents who live there."

 

Report by Director of Services for Economic Development, Planning, Environment and Transportation.

"As previously advised at the March 2021 Council meeting, and the July 2021 Municipal District meeting, the while the Council normally priortises taking in charge requests based on the date a request was made, in the case of The Lock, as it is a small development, has been completed for over 20 years, and where no works to complete the development are required, it may be considered for inclusion in the next tranche of taking in charge.

 

The Council is still engaged in resolving outstanding issues with the previous tranche of estates taken in charge and has not yet determined which estates that may be included in the next tranche of taking in charge. In order for an estate to be taken in charge, a number of pre-requisites have to be completed, including obtaining the agreement of Irish Water. As a consequence, at this time the Council is not in a position to advise which estates may be taken in charge and can only do so when it is in a position to initiate the statutory declaration of public roads public consultation process for the next tranche of estates. While The Lock estate will be considered, the Council can give no guarantee that the process necessary to qualify will be completed in time for the next tranche of taking in charge.

 

With regard to the issue of the lack of street lighting in this estate, as previously advised, the development sought planning permission without any street lighting being proposed; with permission being granted on that basis. As the estate was not intended to have street lighting provided as an integral part of the development, the Council will not be providing any street lighting as part of the taking in charge process and any street lighting at this location will have to be considered under the Council’s street lighting programme; where it will be subject to the usual budgetary and priority considerations."

 

Cathaoirleach, Councillor Sean McGowan said he was happy that this will be considered, and he highlighted the need for street lighting at this location.

 

Mr Joseph Gilhooly said Leitrim County Council are happy to work with the residents to ensure lighting can be provided and Leitrim County Councill will continue to work on the taking in charge.

 

Councillor Des Guckian supported the motion, and he said it was a disgrace that this estate was left without public lighting. The estate should be taken in charge and public lighting should be provided.

Motion from Councillor Sean McGowan - Junction at Road No LP 1630-0

I ask Darragh O’Boyle, Area Engineer, Carrick-on-Shannon, to have immediate discussions with the landowner at the Junction of the Rooskeynamona –Keelagh road, No. LP-1630-0 onto the R202 at the townland of Keelagh, the area known locally as "Gort Cut", with a view to removing and setting back the stone wall.
There is a limited view back towards Dromod for motorists and other road users coming onto the R202 which is a very busy road & it is extremely dangerous.

To consider the following Notice of Motion submitted by Councillor Sean McGowan;

 

"I ask Darragh O’Boyle, Area Engineer, Carrick-on-Shannon, to have immediate discussions with the landowner at the Junction of the Rooskeynamona –Keelagh road, No. LP-1630-0 onto the R202 at the townland of Keelagh, the area known locally as "Gort Cut", with a view to removing and setting back the stone wall.

Report by Roads - General

"We can submit this scheme for Low Cost Safety funding. The success of any LCS application depends on the land owner agreement to novate private lands and number of recorded incidents which have occurred at the location."

 

Cathaoirleach, Councillor Sean McGowan said it was extremely difficult for people to get a clear view when coming from Mohill and Dromod on this very busy road.

 

Councillor Paddy Farrell supported the motion and said this junction needs urgent attention.

 

Councillor Thomas Mulligan supported the motion and said this junction is seriously in

need of some work. There is an ongoing situation with leaves gathering here and the existing drain is not able to take all the water away and some additional drainage is needed.

 

Councillor Des Guckian also supported the motion and said frost and snow have a serious impact at this location also.

 

Mr Darragh O’Boyle said the wall at this location is a listed structure. Low-Cost Safety funding application can be made for works at this location. The success of the funding application depends on the co-operation of the landowner.

 

Cathaoirleach, Councillor Sean McGowan proposed that discussions take place with the landowner.

Leitrim County Council have the following project ready to commence construction with an anticipated 2023 substantial completion date.

Dromahair Housing Project - 4 Units - Anticipated 2023 substantial completion date: December 2023

 

The total number of additional Social Housing Units to be provided by Leitrim County Council by the end of 2023 is 57 Units."

 

Councillor Finola Armstrong McGuire said she has received a lot of enquiries from people as there is a huge need for housing.

 

Councillor Finola Armstrong McGuire acknowledged that there are 17 units in Carrick-on-Shannon which she said is not enough and she said this will need to be reviewed when the Carrick Plan is being prepared.

 

Councillor Enda Stenson supported the motion, and he commended the Council on the numbers and he stressed that family houses need to be built as there is not enough of these type of units.

 

Councillor Des Guckian said every sort of excuse is being given by the Housing Department for not giving housing for the elderly and people who need a home.

 

Cathaoirleach, Councillor Sean McGowan said there is a huge demand for housing nationally and this is a big problem for the Government and more funding is needed.

 

Mr Joseph Gilhooly said the Housing Action Plan as presented to the members last December is well ahead of target.

Motion from Councillor Finola Armstrong McGuire - Sewerage disposal of all effluent from current or new build homes in the Hartley area

In planning the extension of both the Blueway from Carrick-on-Shannon, and the new bridge for Hartley, I ask has this council submitted any data to government departments outlining the urgent need to attend to the safe sewerage disposal of all effluent from current or new build homes in the Hartley area?

To consider the following Notice of Motion submitted by Councillor Finola Armstrong-McGuire;

 

"In planning the extension of both the Blueway from Carrick-on-Shannon, and the new bridge for Hartley, I ask has this council submitted any data to government departments outlining the urgent need to attend to the safe sewerage disposal of all effluent from current or new build homes in the Hartley area?"

"It is the responsibility of the homeowner to ensure that their sewerage is treated safely. Existing septic tanks are inspected by the Council as per the National Inspection Programme and advisory notices issued if the septic tank is not performing.

 

When constructing the new Blueway if a pollution incident coming from a septic tank is noted than this will be logged as a complaint and a septic tank inspection will be triggered.

 

As part of the National Inspection Programme of Domestic Wastewater Treatment Systems a number of septic tank inspections were undertaken at properties in the Hartley area over the past few years. Some of these properties failed the inspection and advisory notices were issued to houseowners. However, some homeowners were reluctant to upgrade septic tank as they were waiting for the construction of the new group sewerage scheme.

 

Leitrim County Council made submissions to the Rural Water Department in the Department of Housing, Planning and Local Government and the proposed Group Sewerage Scheme at Hartley has not been approved as they considered it to be well outside the affordability criteria for approval.

 

From discussions with the Department in relation to this application and their final decision to refuse, the rational for which is confirmed in the Ministers letter, it is clear that this scheme will not at any juncture be approved for funding and nothing more can be done.

 

The Council have recommended to the group that they need to move on and wind up their application and seek payment of the grant towards their costs to date."

 

Councillor Finola Armstrong McGuire said we cannot ignore the need for the town sewerage to be extended out towards Hartley. Councillor Finola Armstrong McGuire expressed her disappointment with the reply received and she said the residents are extremely disappointed and would not welcome this reply. Councillor Armstrong McGuire said the residents want the best for their area and want to keep it up to date and a sewerage system needs to be put in place now when the other works are taking place in this area.

 

Councillor Enda Stenson supported the motion.

 

Councillor Des Guckian said this issue is going on for too many years, and it time to put a scheme in place at a reasonable cost.

 

Cathaoirleach, Councillor Sean McGowan also supported the motion.

Motion from Councillor Thomas Mulligan - Bridge Improvement Programme 2023

That the bridge on the local road in Treanmore, linking Treanmore and Tawlaghtmore be included in the bridge improvement scheme for 2023.

To consider the following Notice of Motion submitted by Councillor Thomas Mulligan;

 

"That the bridge on the local road in Treanmore, linking Treanmore and Tawlaghtmore be included in the bridge improvement scheme for 2023."

 

Report by Roads - General

"This bridge is located on the public road L-7484 in Tamlaght More Td. We will inspect & assess the bridge and will consider it as part of the 2023 bridge rehabilitation program."

 

Councillor Thomas Mulligan said the bridge is in bad repair and it has a potential to become an amenity area. Councillor Thomas Mulligan paid tribute to the aesthetic improvements that have being carried out on bridges.

 

Councillor Enda Stenson and Councillor Sean McGowan supported the motion.

 

Mr O’Boyle said the bridge will be inspected and considered as part of the 2023 Bridge Rehabilitation Programme.

Motion from Councillor Thomas Mulligan - Mohill Horse Fair Festival

I am asking the Council to investigate the possibility of including insurance cover for “Mohill Horse Fair Festival” as part of their corporate insurance in light of the Committee not being successful in their attempts to acquire cover following the break in continuity of cover over the Covid period.

 

Minutes:

To consider the following Notice of Motion submitted by Councillor Thomas Mulligan;

 

"I am asking the Council to investigate the possibility of including insurance cover for “Mohill Horse Fair Festival” as part of their corporate insurance in light of the Committee not being successful in their attempts to acquire cover following the break in continuity of cover over the Covid period."

"The Council has examined the situation in regard to the possibility of including third party events within the Council insurances. The Council is not in a position to provide insurance cover to any event which is outside of the control and responsibility of the Council."

 

Councillor Thomas Mulligan gave the background to his motion and said the festival is based around horses and it is a significant event that attracts a large number of people. The Insurers decided not to cover the event anymore using the excuse of the break in continuity of cover over the Covid period. Councillor Mulligan said this is the only event of its kind  that takes place in the county, and it should not be allowed to fall. Councillor Mulligan said it was his belief that Clare and Galway local authorities have stepped in to support similar horse fairs in their counties. Cllr Mulligan said it would be a shame to lose such a cultural, historical, and social event that takes place on the streets in Mohill. He said although the organising committee stepped away from the event last year and it was not advertised or promoted, the fair proceeded unsupervised, as it is so popular as people turned up with horses as that it what they have always done.

 

Councillor Thomas Mulligan paid tribute to the help and support from volunteers who previously helped with the organisation and clean-up of the streets after the event.

 

Councillor Enda Stenson supported the motion and said Mohill does not get much funding and  it would be a pity to let the fair drop because of insurance and he re-iterated that the Council should do whatever we can to assist. Councillor Des Guckian said Mohill should get the help it needs, and insurance cover should be provided by Leitrim County Council.

 

Councillor Paddy Farrell, Councillor Finola Armstrong McGuire and Councillor Sean McGowan also supported the motion.

 

Mr Joseph Gilhooly said Leitrim County Council are very supportive of Mohill and he referred to funding granted for the Station House project, and the public realm improvement works in Mohill. Mr Gilhooly said Leitrim County Council cannot insure community events and he acknowledged that the horse fair is a cultural and community event. He said Leitrim County Council do share the frustration and he acknowledged this is an increasing issue.

 

Councillor Enda Stenson sought clarification on who issues insurance for Arts events.

 

Councillor Thomas Mulligan said the fair in Spancil hill was taken under the umbrella of Clare County Council.

Motion from Councillor Paddy Farrell - Roundabout at Coffey's

I ask Leitrim County Council if they ever carried out a study, or would have any interest in doing one, to investigate if relocating the existing pedestrian crossing on the N4, beside the roundabout at Coffeys, to a different location, would help with the flow of traffic on the N4.

"I ask Leitrim County Council if they ever carried out a study, or would have any interest in doing one, to investigate if relocating the existing pedestrian crossing on the N4, beside the roundabout at Coffeys, to a different location, would help with the flow of traffic on the N4."

 

Report by Roads - General

"There are no plans to relocate this Pedestrian Crossing. This crossing point was examined a number of years ago and modifications were carried out at the time to alleviate traffic congestion at Bridge Street. These modifications had a positive effect. Relocating this crossing nearer the Roundabout at Coffey’s would cause issues with traffic coming off the roundabout while relocating it in the other direction would take it away from the desired line for pedestrians from Bridge Street to the Quays and the Carpark there, and thus could lead to pedestrians crossing the N4 sporadically."

 

Councillor Paddy Farrell asked if the existing pedestrian crossing on the N4 near the roundabout at the bridge could be relocated.

 

Mr Terry McGovern, Senior Engineer, advised members that this has already been considered a number of years ago and modifications were carried out at the time to alleviate traffic congestion at Bridge Street. These modifications had a positive effect. The pedestrian crossing cannot be moved any closer to the roundabout and if it is moved closer to the Landmark Hotel, pedestrians will not use it. He said it is really at the best location beside the Quay’s carpark.

 

Councillor Finola Armstrong McGuire asked when the signage that she had requested previously at a Carrick-on-Shannon MD meeting would be put in place, as this would help alleviate the situation.

 

Mr O’Boyle said this is in hand and it will be put in place by the Capital office.

Motion from Councillor Paddy Farrell - Cutting of Trees

I call on District Engineer Darragh O’Boyle to give an update on the cutting of trees and scrub along the N4 in the Carrick-on-Shannon MD area.

"I call on District Engineer Darragh O’Boyle to give an update on the cutting of trees and scrub along the N4 in the Carrick-on-Shannon MD area."

 

Report by Roads - General

"We have assigned a tree surgeon to remove trees on Leitrim County Council property at the Masonite Junction (R201/N4) and also along both sides of the approach to Annaduff. The contractor has assured me that he will carry out these works in October. These locations have been approved and funded by the TII. No other areas are included in our proposed works."

 

Councillor Paddy Farrell said he would like to see the cutting of trees and scrub along the N4 and out at Jamestown as soon as possible.

 

Mr O’ Boyle said a tree surgeon has been assigned to remove trees on Leitrim County Council property at the Masonite Junction and both sites of the approach to Annaduff in October of this year. Further funding will be sought from the TII for remaining trees at this location.

 

Councillor Des Guckian welcomed this.

May I get an update on the Fawn Group Sewage scheme in Leitrim Village. Tthis is a very important scheme as it runs right along the Canal and the much used walking route from Leitrim to Kilclare and connecting with Sheemore.

"May I get an update on the Fawn Group Sewage scheme in Leitrim Village. This is a very important scheme as it runs right along the Canal and the much used walking route from Leitrim to Kilclare and connecting with Sheemore."

"This GSS was submitted in the MAWRP 2016-2018 and 2019-2021 and was unsuccessful in getting funding.

In June 2021, Rural Water wrote out to all of these unsuccessful GSS’s to enquire if they were interested in submitting again for the new 2022-2025 programme. Fawn GSS put in an application with an updated list of connections. This has not been submitted to the Dept as the programme has not opened yet, it has been kept on file.

At this point in time, we have not been advised by the Dept of a new measure for sewerage schemes. Rural Water have been in contact many times with the spokesperson of the group, advising that until we hear further from the Dept, nothing will change."

 

Councillor Enda Stenson gave the background to his motion and said there was 12-15 houses included in the agreement for this Group Sewage scheme. The group have requested an update as to why the scheme has come to a halt.

 

Councillor Paddy Farrell supported the motion, and he said last year he was advised that the area was too rocky and there would be no sewerage scheme out there.

 

Mr Joseph Gilhooly advised that the Group Sewerage Scheme was unsuccessful in getting funding previously. The Fawn GSS have put in an application with an updated list of connections, when the Department open the programme, this application will be forwarded to the Department for approval. Fresh contact will be made with the group when the scheme re-opens.

 

Cathaoirleach, Councillor Sean McGowan, Councillor Finola Armstrong McGuire and Cllr Des Guckian also supported the motion.

Motion from Councillor Enda Stenson - Liscara Housing Development

May I have an update on taking in charge of Liscara housing development.

Minutes:

To consider the following Notice of Motion submitted by Councillor Enda Stenson;

 

"May I have an update on taking in charge of Liscara housing development."

 

Report by Director of Services for Economic Development, Planning, Environment and Transportation.

"The Council is still engaged in resolving outstanding issues with the previous tranche of estates taken in charge and has not yet determined which estates that may be included in the next tranche of taking in charge. In order for an estate to be taken in charge, a number of pre-requisites have to be completed, including obtaining the agreement of Irish Water. As a consequence, at this time the Council is not in a position to advise which estates may be taken in charge and can only do so when it is in a position to initiate the statutory declaration of public roads public consultation process for the next tranche of estates. While the Liscara estate will be considered, the Council can give no guarantee that the process necessary to qualify will be completed in time for the next tranche of taking in charge."

 

Councillor Enda Stenson said there is a great need for taking in charge of this estate, which is an excellent place to live.

 

Councillor Finola Armstrong McGuire supported the motion and queried if all empty units/apartment blocks are being highlighted to the Department.

 

Mr Gilhooly confirmed they are.

 

Councillor Paddy Farrell supported the motion.

 

Councillor Des Guckian asked that information be supplied as to how many developers were involved in this development, and what planning conditions were attached to the development.

 

Mr Joseph Gilhooly said all the developments have gone through the planning process and the planning files are available for the public to view.
